Buy Sensibly Terms of Use

1. BuySensibly.com represents the individual user of the BuySensibly.com service, not advertisers, sponsors, or causes. An individual who signs up with BuySensibly.com becomes a member and enters willingly into this agreement. Users acknowledge that the contribution to charitable causes is made by BuySensibly.com, not by the users.
    
2. The user understands that BuySensibly.com uses its commercially reasonable best efforts to present various online merchants to the user, and enables the user to designate to the user's selected cause, a contribution published on the BuySensibly.com site for each purchase. ("BuySensibly.com merchants" are defined as any merchant currently participating as a merchant in the Mall at www.BuySensibly.com.)  A BuySensibly.com user understands that to raise that contribution, the user must start their shopping at the Mall at www.BuySensibly.com or through a BuySensibly.com Newsletter.  The user agrees that the advertised proceeds resulting from their donation-generating activities (referred to as "Contributions") will be disbursed to a qualified organization designated by the user.  The user also understands that BuySensibly.com uses marketing fees that merchants pay BuySensibly.com, to contribute to the user's cause.   

3. The user understands that BuySensibly.com will make Contributions to a designated cause 15-21 days after it receives merchant reports of orders placed by the user, which could be 30-45 days after they place the order.  The contribution will be posted on the user's account on the site after we receive and process the merchant report.  BuySensibly.com will make the contribution to a cause after it accumulates at least $100 of contributions across all users, given overhead costs of making small contributions.  The user also understands that the contribution associated with the order is contingent on receipt of payment from the merchant.  If we do not get paid by the merchant for the order, including but not limited to the case where the user returns or reverses the order, BuySensibly.com will reverse the Contribution associated with the order.
    
4. You must remain a user (which includes providing us a valid e-mail address at which we're allowed to contact you) for at least 2 months after signup and be opted in to receive email updates and newsletters, for a contribution to be paid to your selected cause.  We reserve the right to not attribute a contribution to your orders if you opt out of our email updates, newsletters.
    
5. BuySensibly.com will not disclose "personally identifiable" information regarding its users to any third party without the user´s explicit permission, except as may be required by law or action of a court of competent jurisdiction.
    
6. BuySensibly.com reserves the right to refuse any users, advertiser, advertisements, or recipient organizations.
    
7. User understands that the economic basis of BuySensibly.com is delivering real transactions.  Any action by the user that undermines that basis may disqualify the contributions attributed to a user.  Contributions attributed to a user may be disqualified, at the sole discretion of BuySensibly.com, if the member attempts (1) to use BuySensibly.com through any means other than through participating sign-up pages; (2) to disrupt BuySensibly.com or circumvent the terms and conditions of this Agreement; (3) to use automated means to create entries/registrations; (4) register on behalf of another person; (5) provide false or unverifiable information to BuySensibly.com; or (6) sign up multiple times.  And, if any of the above or other attempts to defraud advertisers or BuySensibly.com occur, BuySensibly.com reserves the right to remedy any such action, disruption or circumvention in a manner, determined solely by BuySensibly.com, that is fair and equitable to other members, advertisers, and nonprofits. BuySensibly.com may not give notice in such an instance.  All information posted and received is subject to final audit.
    
8. Member understands that BuySensibly.com will use its best efforts to collect a rebate from the Mall merchants, and disburse any and all advertised proceeds resulting from the member's donation-generating activities to a selected cause or to the member.
    
9. A BuySensibly.com member must be at least 13 years old.
    
10. Active Member.  Being an active BuySensibly.com member is important, because that generates the revenues that allow us to funnel money to our members´ favorite causes.  BuySensibly.com defines an active member as a member who a) receives our e-mail newsletters or visits the BuySensibly.com site (Home page) at least twice a month (in two different weeks), and/or b) has made a purchase from an BuySensibly.com merchant at least once in the last 60 days.  A member must remain active for at least 60 days after his or her initial registration for an initial donation or promotion to become effective.
     
11. Tax Deductibility. The contributions are made by BuySensibly.com, not by the user, and are not tax deductible by the user.
